Cancellation policy
Customers have the right to withdraw from the contract within fourteen days (two years) without giving reasons. This right applies to natural persons who act in their role as consumers, i.e. who do not conduct business predominantly in connection with their commercial or independent professional activity.
Right of withdrawal
Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag, an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die letzte Ware in Besitz genommen haben bzw. hat.
In order to exercise your right of withdrawal, you must contact us (SpiritsUp GmbH, Leopold-Ungar-Platz 2/Stiege 2/Top 289, 1190 Vienna, Austria office@mft-group.at, telephone: +43192808631) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You can use the attached sample withdrawal form, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.
The consumer has no right of withdrawal for distance or off-premises contracts concerning – goods or services whose price depends on fluctuations in the financial market that are beyond the control of the trader and may occur within the withdrawal period – goods that are made according to customer specifications or are clearly tailored to personal needs – goods that may spoil quickly or whose expiration date would be quickly exceeded – goods that are delivered sealed and are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery – goods which, after delivery, have been inseparably mixed with other items due to their nature – alcoholic beverages whose price was agreed upon at the time of conclusion of the contract, but which can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on market fluctuations over which the trader has no influence – audio or video recordings or computer software delivered in a sealed package, if the seal has been removed after delivery – newspapers, magazines or illustrated publications, with the exception of subscription contracts for the delivery of such publications – services in the areas of accommodation for purposes other than residential use, transport of goods, car rental, as well as the delivery of food and beverages, and services related to leisure activities, provided that the contract stipulates a specific date or period for the performance of the service by the trader.
Refund / consequences of revocation
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days (two years) from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.
We may refuse to refund you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.
In the event of a defect, the customer must note this on the delivery bill upon receipt and report it immediately. Non-visible defects must be reported after discovery, but within the statutory deadlines.
Upon receipt of the notice of defects, SpiritsUp GmbH will examine the claim and decide whether the defect will be remedied by improvement, replacement, price reduction or termination of the contract.
Sie haben die Waren unverzüglich und in jedem Fall spätestens binnen vierzehn Tagen ab dem Tag, an dem Sie uns über den Widerruf dieses Vertrags unterrichten, an uns oder an SpiritsUp GmbH (Josef Hafner Srasse 12, 2100 Korneuburg) zurückzusenden oder zu übergeben. Die Frist ist gewahrt, wenn Sie die Waren vor Ablauf der Frist von vierzehn Tagen absenden.
The Customer shall bear the direct costs of returning the goods, unless the defect was already present at the time of delivery and is recognized by SpiritsUp GmbH.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.
The goods should be carefully packed and preferably returned in the original packaging to avoid damage in transit.
Reasons for exclusion or expiry
The right of withdrawal does not apply to contracts for the delivery of goods that are individually manufactured according to the consumer's wishes or are clearly tailored to the consumer's personal needs. Also excluded from the right of withdrawal are contracts for the delivery of perishable goods or goods with a short expiration date.
Which goods can be returned and which cannot?
Excluded from the right of withdrawal are goods according to customer specifications, perishable goods, sealed goods that cannot be returned after the seal has been removed for reasons of hygiene, and goods that have been inseparably mixed with other goods after delivery, as well as other exceptions specified in the GTC.
General information
1) Please handle the goods carefully when returning them and send them back in the original packaging together with all accessories and packaging components. If the original packaging is no longer available, please use suitable outer packaging to adequately protect the goods from damage in transit.
2) Bitte senden Sie die Ware nicht unfrei an uns zurück.
3) We would like to point out that although the above points 1 and 2 are recommended, they are not mandatory in order to effectively exercise your right of withdrawal.
